Working in the U.S. under the H-2 Visa - Work Permit

The H-2 visa is intended for non-citizen immigrants interested in entering the country to work on a temporary or seasonal basis. The two different kinds of H-2 visa are:

  • H-2A: The H-2A visa is intended for agricultural workers who are interested in working in the United States on a temporary basis picking crops or performing other farm labor or agricultural work. According the terms of the H-2A visa, you must already have a job offer from an employer before you can apply for the H-2A visa. Once you obtain the visa, you can stay in the U.S. no longer then 3 years before you must leave.
  • H-2B: The H-2B visa is intended for non-citizen immigrant workers interested in performing temporary or seasonal skilled or unskilled work, such as roofing or construction work. In order to apply for the H-2B visa, you must have a job offer from an employer and you must be able to document the job offer at the time of your visa application.
